1. About this notice
This notice forms part of the Terms & Conditions for the Melvive app and website operated by Mel Deane. Please read it before using Melvive to exercise.
2. How we adjust for aches and injuries
Melvive uses the aches, injuries, severity and other fitness information you report to adjust workout suggestions, including exercise substitutions, omissions or changes to training volume and load where available. Keep this information accurate and up to date.
These adjustments are automated fitness suggestions, not a clinical assessment or a rehabilitation plan. Melvive cannot examine an injury, monitor your technique or physical condition, or know every factor affecting your safety. An adjusted exercise is not a guarantee that it is suitable or safe for you, and suggestions may be incomplete or wrong.
Follow the advice and restrictions given by your doctor, physiotherapist or other qualified healthcare professional. Do not use Melvive to override that advice or to train through an injury.
3. Exercise risks
Exercise involves inherent risks, including strains, sprains, falls, equipment accidents and aggravation of an existing or previously unknown injury or health condition. Serious injury can occur even when precautions are taken. By choosing to exercise, you acknowledge these inherent risks.
4. Train within your limits
- Seek advice from a qualified healthcare professional before starting or changing exercise if you have an injury, a medical condition or concerns about whether you can exercise safely.
- Choose exercises, weights and intensity appropriate to your current ability. Reduce, skip or stop an exercise that does not feel suitable; you do not need to complete a suggested workout.
- Use appropriate technique, suitable and well-maintained equipment, and a safe training environment. Get qualified supervision if you are unsure how to perform an exercise.
- Stop exercising if you experience pain, dizziness or feel unwell, and seek appropriate medical advice. Seek urgent medical help for severe or concerning symptoms.
- Keep your injury information and feedback up to date. Reporting an injury does not mean Melvive has assessed it or confirmed you are fit to train.
5. Your rights and our responsibilities
You are responsible for your exercise choices, technique, equipment and training environment. Acknowledging the inherent risks of exercise does not release Melvive from its legal responsibilities or mean you give up a right to claim compensation.
Nothing in this notice excludes or limits liability for death or personal injury arising from our acts or omissions, including negligence, or any other liability that cannot lawfully be excluded or limited. Your statutory consumer rights and access to legal remedies are unaffected.
6. AI and your information
AI personalisation is optional. Acknowledging this safety notice or accepting the Terms does not give permission to share your information with AI providers. That requires your separate AI choice, which you can change in Profile.
