Terms & Conditions

These terms govern your use of the Melvive app and website. Please read them carefully.

Last updated: 22 October 2026

1. About these terms

These Terms & Conditions (“Terms”) are a binding agreement between you and Mel Deane (“Melvive”, “we”, “us”, “our”), the operator of the Melvive mobile app and website (together, the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Injury disclaimer. If you do not agree, do not use the Service.

2. Health disclaimer — important

Melvive provides general fitness information and AI-generated workout suggestions only. It is not medical advice and is not a substitute for professional medical or fitness supervision. Consult a qualified healthcare professional before starting or changing any exercise programme. You exercise at your own risk. See our Injury disclaimer for details about exercise risks, injury adaptations and your legal rights.

3. Eligibility and accounts

  • You must be at least 18 years old (or the age of majority where you live) to use the Service.
  • You are responsible for keeping your account credentials secure and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date. Inaccurate information may reduce the quality and safety of workout suggestions.
  • You must notify us promptly of any unauthorised use of your account.

4. The Service and AI-generated content

Melvive uses algorithms and artificial intelligence to generate personalised workout suggestions based on the information you provide. You acknowledge that:

  • Suggestions are generated automatically and may be inaccurate, incomplete, or unsuitable for you.
  • Suggestions are general guidance only and do not account for your real-time physical condition, technique, or environment.
  • You are responsible for deciding whether any suggestion is appropriate and safe for you, and for how you perform any exercise.
  • We may change, improve, or discontinue features of the Service at any time.

5. Subscriptions and payments

  • Some features require a paid subscription (a “Melvive Membership”). Pricing and billing terms are shown at the point of purchase.
  • Subscriptions purchased through the Apple App Store are billed and managed by Apple under its terms, and subscriptions purchased through other channels are billed by us or our payment partner.
  • Subscriptions renew automatically unless cancelled before the end of the current billing period. You can manage or cancel via your app store account or account settings, as applicable.
  • Except where required by law or an applicable store policy, payments are non-refundable. Refunds for app store purchases are handled under the relevant store’s policies.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose;
  • Post or share content in community features that is illegal, harmful, harassing, infringing, or that you do not have the right to share;
  • Attempt to access, disrupt, reverse engineer, or interfere with the Service or its security;
  • Misuse, scrape, or resell the Service or its content; or
  • Impersonate others or misrepresent your identity.

You retain ownership of content you submit, but grant us a licence to host, store, and display it as needed to operate the Service. We may remove content or suspend accounts that breach these Terms.

7. Intellectual property

The Service, including its software, design, branding, and content (excluding your own content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms.

8. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any suggestion will be safe, accurate, or achieve any particular result.

9. Exercise risks and responsibility

Exercise carries inherent risks. You are responsible for exercising within your ability, using suitable technique and equipment, and maintaining a safe training environment. Melvive adjusts suggestions using the aches and injuries you report, but cannot assess an injury, provide medical clearance or guarantee that an exercise is safe for you. See the Injury disclaimer for the limits of these adaptations.

10. Your consumer rights

Nothing in these Terms excludes or limits liability for death or personal injury arising from our acts or omissions, including negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Your statutory consumer rights and access to legal remedies are unaffected.

11. Optional AI personalisation

Accepting these Terms or acknowledging the Injury disclaimer does not authorise sharing your personal information with AI providers. AI personalisation requires your separate, optional choice. You can continue with rules-based personalisation and change your AI choice in Profile at any time.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably need to protect the Service or other users. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnity) will continue to apply.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except where mandatory local consumer law gives you the right to bring proceedings elsewhere.
